I. PREÂMBULO – DADOS GERAIS

Este Acordo para instauração do regime de cotutela com titulação simultânea de Dissertação de Mestrado ou Tese de Doutorado (definir se Dissertação de Mestrado ou Tese de Doutorado) é celebrado entre a

UNIVERSIDADE FEDERAL DE SANTA MARIA (UFSM), fundação de direito público criada pelo Decreto-Lei nº 3.834-C/1960, inscrita no Cadastro Nacional de Pessoa Jurídica (CNPJ) sob o nº. 95.591.764/0001-05, com sede na Avenida Roraima nº 1000 Cidade Universitária, Reitoria, Bairro Camobi, Santa Maria, RS, Brasil, doravante UFSM, e-mail gabinetereitor@ufsm.br, neste ato representada por

REITORA MAGNÍFICA MARTHA BOHRER ADAIME, por um lado

II. ASPECTOS ADMINISTRATIVOS

Todas as disposições, requerimentos e regulamentações consignadas nas Resoluções nº 139/2023/UFSM e nº 230/2025/UFSM que aprovam o Regulamento Geral da Pós-Graduação Stricto Sensu da Universidade Federal de Santa Maria (UFSM) e na INSTRUÇÃO NORMATIVA PRPGP nº 16/2026/PRPGP, nos aspectos que tratam especificamente do regime de Cotutela com Titulação Simultânea (aqui designado como ‘Cotutela’), deverão ser atendidas a instauração da Cotutela.

i. Matrícula

Obrigatoriamente, o(a) discente/solicitante deverá estar regularmente matriculado em um Curso de Pós-graduação na Universidade Federal de Santa Maria, Santa Maria, RS, Brasil, ou em Curso de Pós-graduação de Instituição de Ensino Superior Estrangeira.

ii. Duração do regime de Cotutela

Desde a celebração deste Acordo (assinatura do presente documento) até a conclusão e defesa pública da Dissertação de Mestrado ou Tese de Doutorado (incluindo emissão dos diplomas em ambas instituições).

O(a) mestrando(a)/doutorando(a) deverá exercer sua atividade alternadamente nas duas instituições signatárias, de acordo com o cronograma de atividades estabelecido em conjunto pelos orientadores (da UFSM e da Instituição estrangeira), conforme descrito na Seção III (subseção ‘vi’) abaixo.

iii. Seguro-Saúde

É obrigatória a contratação de seguro-saúde com cobertura mínima para vida (morte ou invalidez acidental), saúde, acidentes, enfermidades e repatriação em todo território brasileiro, por todo o período de duração da mobilidade acadêmica presencial na UFSM.

III. PREPARAÇÃO, ELABORAÇÃO E DEFESA PÚBLICA DA DISSERTAÇÃO DE MESTRADO OU DA TESE DE DOUTORADO

i- Obrigações dos(as) orientadores(as)

Na Universidade Federal de Santa Maria, Santa Maria, Brasil, o(a) mestrando(a)/doutorando(a) deve exercer as atividades sob a orientação do Prof(a). Dr(a). XXX (nome do orientador UFSM).

vi. Cronograma de atividades

Os(as) orientadores(as) (da UFSM e da Instituição estrangeira) comprometem-se a exercer conjuntamente a orientação de mestrado/doutorado, ambos concordando com o cronograma de atividades estabelecido abaixo. O calendário das atividades do(a) discente-solicitante é acordado conjuntamente pelos(as) orientadores(as) (da UFSM e da Universidade XXX).

O planejamento de execução da Cotutela em cada instituição/PPG (UFSM e Instituição estrangeira) (tais como, desenvolvimento e integralização das disciplinas, informando número de créditos; estágios; etapas de execução do projeto de Dissertação ou Tese; desenvolvimento de outros projetos de pesquisa; atividades correlatas; defesa de dissertação/tese, etc) deve estar descrito abaixo.

     vii. Defesa Pública da Dissertação/Tese (definir se Dissertação ou Tese)

A defesa pública da Dissertação/Tese deve ser realizada em conformidade com os regulamentos em vigor.

A defesa pública será realizada com a concordância dos(as) dois(duas) orientadores(as) (UFSM e instituição estrangeira), de acordo com as atribuições mutuamente acordadas entre os(as) dois(duas) orientadores(as) e aceitas pelas respectivas instituições.

Os nomes de ambos(as) orientadores(as) devem ser especificados na capa do Documento da Dissertação/Tese e em todos os documentos pertinentes elaborados após a assinatura do presente Acordo.

Previamente à realização da defesa, ambas as instituições (via Coordenação do PPG) envolvidas no regime de Cotutela devem certificar que o(a) estudante se encontra apto(a) para defender a Dissertação/Tese, por meio da Autorização do Processo de Defesa (modelo do Anexo II, emitido automaticamente pelo processo de defesa da UFSM, quando a defesa ocorrer na instituição estrangeira) ou da Declaração de Anuência para Defesa (modelo Anexo III, quando a defesa ocorrer na UFSM).

A Dissertação/Tese será redigida integralmente em XX (definir a língua), ou parcialmente em português (designar as partes xx) e em XXX (designar as partes xx).

A Dissertação/Tese será defendida na Universidade XXX, em (Local) , pelos motivos explicitados na ‘Carta de Motivação do local da Defesa’, a ser redigida abaixo. A escolha e definição do local de defesa implica em estar plenamente ciente e sujeito a uma das quatro circunstâncias descritas subsequentemente.

Defesa de Dissertação/Tese sob responsabilidade da UFSM de discente regular de PPG da UFSM:

Todas as determinações dispostas no Regulamento Geral da Pós-Graduação Stricto Sensu da Universidade Federal de Santa Maria e no Regulamento do respectivo PPG-UFSM de origem do(a) solicitante deverão ser atendidas.

Eventuais requisitos específicos à submissão de defesa de Dissertação/Tese dispostos pelos referidos Regulamentos da UFSM poderão deixar de ser exigidos à defesa em Cotutela na UFSM desde que estejam claramente estabelecidos neste Acordo e tenham sido aprovados pelo PPG de origem do(a) discente-solicitante e pela PRPGP da UFSM.

Assim, por autorização do Colegiado do Programa de Pós-Graduação em XXX da UFSM, na abertura do processo de defesa de Dissertação/Tese do(a) discente, não serão exigidos os requisitos listados a seguir, os quais estão estabelecidos no Regulamento do PPG:

Para efeito procedimental da defesa, deve-se proceder com a abertura e tramitação de processo de defesa no sistema UFSM, como instruído e regulamentado pela PRPGP/UFSM.

A Declaração de Anuência para Defesa, emitida pela instituição estrangeira (anexo III), deverá ser tramitada junto ao processo de defesa na UFSM.

Defesa de Dissertação/Tese sob responsabilidade da Instituição estrangeira de discente regular de PPG da UFSM:

Na hipótese de a defesa ocorrer sob responsabilidade da universidade estrangeira, regras e determinações específicas para o procedimento de defesa na instituição estrangeira deverão ser respeitadas, e terão efeitos idênticos em termos oficiais e legais ao procedimento de defesa da UFSM.

Trinta (30) dias antes da defesa ocorrer na instituição estrangeira, o(a) discente deverá abrir processo simplificado de defesa para prover a UFSM a informação da realização da defesa na instituição estrangeira.

A Autorização do Processo de Defesa para Defesa (modelo do Anexo II, emitido automaticamente pelo processo de defesa da UFSM) deverá ser enviada a IES estrangeira.

Após a realização da defesa, os seguintes documentos devem ser anexados ao processo de defesa aberto previamente:

- Documento oficial da instituição estrangeira, atestando a aprovação da defesa.

- Dissertação/Tese em sua versão final.

Defesa de Dissertação/Tese sob responsabilidade da UFSM de discente regular do PPG da Instituição estrangeira:

Trinta (30) dias antes da defesa, o(a) orientador(a) do PPG da UFSM, em comum acordo com o(a) discente e anuência da instituição estrangeira, deverá proceder com a abertura de processo simplificado de defesa na UFSM, informando se tratar de regime de cotutela no ato da abertura de processo.

A Declaração de Anuência para Defesa, emitida pela instituição estrangeira (anexo III), com ciência do(a) discente, deverá ser tramitada junto ao processo de defesa na UFSM.

Defesa de Dissertação/Tese sob responsabilidade da Instituição estrangeira de discente regular do PPG da Instituição estrangeira:

Na hipótese de a defesa ocorrer na universidade estrangeira, regras e determinações específicas para o procedimento de defesa na instituição estrangeira deverão ser respeitadas, e terão efeitos idênticos em termos oficiais ao procedimento de defesa da UFSM.  Trinta (30) dias antes da defesa, o(a) orientador (a) do PPG da UFSM, em comum acordo com o(a) discente e instituição estrangeira, deverá proceder com a abertura de processo simplificado de defesa na UFSM, registrando as informações sobre a defesa em regime cotutela para gerar a Autorização do Processo de Defesa (Anexo II).

A Autorização do Processo de Defesa (modelo do Anexo II, emitido automaticamente pelo processo de defesa da UFSM), deverá ser enviada à IES estrangeira.

Nesse sentido, para efeito de oficialização na UFSM (finalização do curso, obtenção de título e emissão de diploma), o(a) orientador (a) do PPG UFSM, em comum acordo com o(a) discente, após a defesa ter ocorrido na instituição estrangeira, deverão encaminhar à Coordenação do PPG-UFSM os documentos abaixo listados:

- Documento oficial da instituição estrangeira, atestando a aprovação da defesa.

- Histórico escolar do Mestrado (se Cotutela de Dissertação de Mestrado) ou do Doutorado (se Cotutela de Tese de Doutorado).

- Dissertação/Tese em sua versão final.

Os referidos documentos deverão ser examinados pela Coordenação e pelo Colegiado do PPG-UFSM. Em havendo o deferimento pelo Colegiado, a Coordenação deve anexá-los ao próprio processo de Cotutela e tramitar o processo à PRPGP.

viii. Emissão de Diplomas

Após a defesa bem-sucedida da Dissertação ou Tese, ambas as instituições parceiras concederão o diploma ao(à) aluno(a) de mestrado/doutorado.

A Universidade Federal de Santa Maria, Santa Maria, Brasil, tomará todas as providências legais necessárias para conferir o diploma com título de Mestre(a)/Doutor(a), de acordo com a legislação em vigor.

Para efeitos de emissão de diploma pela UFSM, independentemente de a defesa ocorrer na UFSM ou na universidade estrangeira, o(a) discente deverá entregar a documentação concernente à defesa ocorrida à Coordenação do PPG-UFSM para procedimentos internos, como usualmente instruído pela PRPGP-UFSM.

A Universidade XXX (nome instituição estrangeira) deve agir de acordo com a legislação nacional e conferir o grau nacional reconhecido de Mestre ou Doutor.

Após o cumprimento de todas as etapas para a obtenção do título de Mestre(a) ou Doutor(a), as instituições parceiras devem apresentar, cada uma, um diploma conferindo o Título de Mestre(a) ou Doutor(a) ao(à) candidato(a). A orientação conjunta internacional e a cooperação dos(as) parceiros(as) deve ser indicada no diploma.

Os diplomas/certificados devem indicar que houve supervisão conjunta (Cotutela) e devem mencionar o nome das instituições parceiras envolvidas no regime de Cotutela.

ix. Arquivamento da Dissertação/Tese e Proteção dos Resultados Comuns da Pesquisa

As providências para proteger e dividir qualquer propriedade intelectual gerada como resultado deste contrato devem ser determinadas neste Acordo. A propriedade intelectual decorrente deve ser adquirida e detida da seguinte forma:

a. Na medida em que a propriedade intelectual seja gerada ou desenvolvida conjuntamente pelas instituições parceiras e/ou pelo(a) discente, então a propriedade intelectual será adquirida e detida conjuntamente pelas instituições parceiras.

b. Na medida em que a propriedade intelectual decorrente for gerada ou desenvolvida por uma das instituições parceiras e/ou pelo(a) discente sem a contribuição intelectual da outra instituição parceira, então ela será adquirida e de propriedade da instituição parceira em questão.

No entanto, as instituições parceiras reconhecem em princípio que os direitos autorais da Dissertação ou Tese pertencem ao(à) discente (e, se for o caso, aos coautores das várias partes/capítulos). Cada instituição parceira pode exigir que o(a) mestrando(a)/doutorando(a) deposite a quantidade de cópias da tese exigida por seu regulamento e conceda acesso aberto ao seu depósito digital universitário.

No caso de ter sido celebrado um acordo por uma das instituições parceiras para a execução das atividades (de investigação) do(a) discente em contrapartida de pagamento por instrução ou em cooperação com terceiros, um acordo de propriedade intelectual diferente (incluindo um regulamento de direitos autorais) pode ser aplicável.

Não obstante o acima exposto, as instituições parceiras terão em todos os casos a liberdade de acordar por escrito disposições diferentes em relação à propriedade intelectual e à comercialização da mesma.

IV. DISPOSIÇÕES FINAIS

O presente Acordo entra em vigor a partir da data de assinatura dos representantes legais das duas instituições e termina no momento em que se cumpram as disposições do artigo III do presente Acordo.

O presente Acordo pode ser rescindido por mútua concordância das partes ou a pedido do(a) mestrado(a)/doutorando(a), com a anuência obrigatória de ambos(as) orientadores(as).

Se uma das partes não cumprir as obrigações deste Acordo, a outra parte tem o direito de solicitar a rescisão deste documento, com base em notificação. A parte que apresentou o pedido tem a obrigação de conceder a outra 30 dias para resolução dos problemas. O presente Acordo é rescindido somente se os problemas permanecerem sem solução no final deste período.

Além disso, o presente contrato é rescindido caso o(a) discente XXX (nome do(a) estudante) perca sua qualidade de mestrando(a) ou doutorando(a) da Universidade Federal de Santa Maria ou da Universidade XXX (nome instituição estrangeira) (caso seja aluno regularmente matriculado em PPG de instituição estrangeira).

Em testemunho do que, as instituições assinam o presente Acordo que traz também as assinaturas dos reitores das instituições parceiras, do(a) mestrando(a) ou doutorando(a) e dos(as) orientadores(as) de mestrado ou doutorado de ambas as instituições em dois idiomas - em português e em inglês.

II. ADMINISTRATIVE ASPECTS

All provisions, requirements, and regulations set forth in Resolutions No. 139/2023/UFSM and No. 230/2025/UFSM, which approve the General Regulations for Stricto Sensu Graduate Programs of the Universidade Federal de Santa Maria (UFSM), and in Normative Instruction PRPGP No. 16/2026/PRPGP, to the extent they specifically address the Joint Supervision with Simultaneous Degree (hereinafter referred to as ‘Joint Supervision’), must be fully complied with for the establishment of the Joint Supervision.

i. Enrollment:

The student/applicant must be regularly enrolled in a graduate course at the UFSM, Santa Maria, RS, Brazil, or in a graduate course at a foreign higher education institution.

ii. Duration of the Dual Degree Program

From execution of the Agreement for the Dual Degree Program (signature of this document) until the completion and public defense of the Master's thesis or Doctoral dissertation (including issuing of diplomas at both institutions).

The Master/ Doctoral candidate must work alternately at the two signatory institutions, according to the schedule of activities established jointly by the supervisors (from UFSM and the foreign institution), as described in Section III (subsection 'vi') below.

iii. Health Insurance

The contracting of health insurance is mandatory, with minimum coverage for life (accidental death or disability), health, accidents, illnesses, and repatriation throughout Brazilian territory, for the entire duration of the in-person academic mobility period at UFSM.

III. PREPARATION, DEVELOPMENT AND PUBLIC DEFENSE OF THE MASTER'S THESIS OR DOCTORAL DISSERTATION

i- Obligations of supervisors

At the UFSM, Santa Maria, Brazil, the master/doctoral students must carry out the activities under the guidance of Dr.  XXX (name of UFSM supervisor ).

vi. Schedule of activities

The supervisors (from UFSM and the foreign institution) commit to jointly supervise the master/ doctoral student, both agreeing to the schedule of activities set out below. The timetable for the student's activities is agreed upon jointly by the supervisors (from UFSM and University XXX).

The plan for the implementation of the Dual Degree in each institution/program (UFSM and foreign institution) (such as the development and completion of subjects, stating the number of credits; internships; stages in the implementation of the thesis or dissertation project; development of other research projects; related activities; thesis/ dissertation defense, etc.) must be described below.

vii. Public Defense of the Thesis/Dissertation (define whether Thesis or Dissertation)

The public defense of the thesis/dissertation must be held by the regulations in force.

The public defense shall be conducted with the agreement of both supervisors (UFSM and the foreign institution), in accordance with the responsibilities mutually agreed upon by the two supervisors and accepted by their respective institutions.

The names of both supervisors must be specified on the cover of the thesis/dissertation document and all relevant documents drawn up after the signing of this Agreement.

Prior to the defense, both institutions (via the Graduate Program Office) must certify that the student is eligible to defend the Dissertation/Thesis, through the Defense Authorization (model in Annex II, issued automatically through the UFSM defense process, when the defense takes place at the foreign institution) or the Statement of Consent for the Defense (model in Annex III, when the defense takes place at UFSM).

The thesis/dissertation will be written entirely in XX (define the language) , or partially in Portuguese (designate parts xx) and in XXX (designate parts xx) .

The thesis/dissertation will be defended at University XXX in (Location) , for the reasons explained in the 'Letter of Motivation for the place of Defense', to be written below. The choice and definition of the place of defense implies being fully aware of and subject to one of the four circumstances described below.

Thesis/Dissertation defense to be held at UFSM by a student regularly enrolled in a Graduate Program at UFSM:

All the provisions set out in the General Regulations for Stricto Sensu Graduate Programs at UFSM (PPG/UFSM) and in the Regulations of the respective graduate program of origin of the applicant must be met.

Any specific requirements for the submission of a thesis/dissertation defense set out in the UFSM Regulations mentioned before may no longer be required for the Dual Degree defense at UFSM provided that they are established in this Dual Degree Agreement and have been approved by the requesting student's original Graduate Program (PPG) and by the Provost Office for Postgraduate Studies and Research (PRPGP/UFSM).

Therefore, with the authorization of the Collegiate Board of the Graduate Program (PPG) in XXX at UFSM, the requirements listed below, as established in the PPG Regulations, will not be required for initiating the student’s thesis/dissertation defense process:

For procedural purposes, the defense process must be opened and conducted in the UFSM system, as instructed and regulated by PRPGP/UFSM.

The Statement of Consent for the Defense, issued by the foreign institution (Annex III), must be submitted together with the defense process at UFSM.

Thesis/Dissertation Defense to be held at a foreign institution of a student regularly enrolled in a Graduate Program (PPG) at UFSM:

If the defense takes place at the foreign university, specific rules and regulations for the defense procedure at the foreign institution must be respected and will have identical effects in official and legal terms to the defense procedure at UFSM.
Even if the defense procedure takes place abroad, the student must open a defense process at UFSM, as normally instructed by PRPGP, indicating that it is a joint degree at the time the process is initiated.

At least thirty (30) days prior to the date of the defense at the foreign institution, the student shall initiate a simplified defense process in order to inform UFSM of the defense to be held abroad.

The Defense Authorization (model in Annex II, issued automatically through the UFSM defense process) must be sent to the foreign higher education institution.

Following completion of the defense, the following documents shall be attached to the previously initiated defense process:

An official document issued by the foreign institution certifying approval of the defense;

The final version of the dissertation /thesis.

Thesis/Dissertation defense to be held at UFSM by a student regularly enrolled in a Graduate Program at a foreign institution:

Thirty (30) days prior to the defense, the advisor of the UFSM Graduate Program (PPG), in agreement with the student and with the consent of the foreign institution, shall initiate a simplified defense process at UFSM, indicating the dual degree at the time the process is initiated.

The Statement of Consent for the Defense, issued by the foreign institution (Annex III), with the student's knowledge, must be submitted along with the defense process at UFSM.

Thesis/Dissertation defense to be held at the foreign institution of a student enrolled in a Graduate Program at the foreign institution:

In the event that the defense is held at the foreign university, the specific rules and requirements governing the defense procedure at that institution shall be observed and shall have effects identical, for official purposes, to the defense procedure conducted at UFSM. Thirty (30) days prior to the defense, the advisor of the UFSM Graduate Program (PPG), in agreement with the student and the foreign institution, shall initiate a simplified defense process at UFSM, registering the information regarding the defense under a dual degree program in order to generate the UFSM Defense Authorization (model in Annex II).

The Defense Authorization (model in Annex II, issued automatically through the UFSM defense process) must be sent to the foreign HEI.

For official recognition at UFSM (course completion, degree conferral, and diploma issuance), the advisor of the UFSM Graduate Program (PPG), in agreement with the student, shall submit the documents listed below to the PPG/UFSM Coordination after the defense has been held at the foreign institution:

- Official document from the foreign institution attesting the approval of the defense.

- Master's degree academic transcripts (if master's thesis) or Ph.D. academic transcripts (if Ph.D. dissertation).

- Thesis/dissertation in its final version.

These documents must be examined by the Coordination and by the Collegiate Council of the PPG/UFSM. Once approved by the Collegiate, the Coordination must attach the documents to the Dual Degree process and submit the process to PRPGP/UFSM.

viii. Issuing of Diplomas

After the successful defense of the thesis/dissertation, both partner institutions will award the diploma to the Master/Ph.D. student.

UFSM will take all the necessary legal steps by current legislation to award the Master's/Ph.D. degree.

To obtain a diploma from UFSM, regardless of whether the defense is conducted at UFSM or at the foreign institution, the student must submit the defense-related documentation to the PPG/UFSM Coordination for internal processing, as normally instructed by PRPGP/UFSM.

University XXX (name of foreign institution) must act by national legislation and confer the nationally recognized Master’s or Ph.D degree.

After completing all the steps to obtain a master's or Ph.D. degree, each partner institution must award the candidate with a diploma conferring the degree of Master or Ph.D. The joint international supervision and cooperation of the partners must be indicated in the diploma.

Diplomas/certificates must indicate that there has been joint supervision (Dual Degree) and must mention the name of the partner institutions involved in the dual degree program.

ix. Archiving the Thesis/Dissertation and Protection of Joint Research Results

The arrangements for the protection and sharing of any intellectual property generated under this Agreement shall be set forth herein. The resulting intellectual property shall be acquired and managed as follows:

a. If the intellectual property is generated or developed jointly by the partner institutions and/or the student, it shall be jointly owned by the partner institutions.
b. If the intellectual property is generated or developed by one partner institution and/or the student without the intellectual contribution of the other partner institution, it shall be owned solely by the institution in question.

Notwithstanding the above, the partner institutions acknowledge that the copyright of the thesis or dissertation belongs to the student (and, where applicable, to co-authors of specific sections or chapters). Each partner institution may require the Master’s or Ph.D. student to submit the number of copies of the thesis/dissertation mandated by its regulations and to grant open access through its institutional digital repository.

If one of the partner institutions has entered into an agreement to conduct the student’s research activities on a tuition-fee basis or in collaboration with a third party, a separate intellectual property agreement (including specific copyright provisions) may apply.

In all cases, the partner institutions remain free to agree in writing to alternative arrangements regarding the ownership, management, or commercialization of intellectual property.

IV. FINAL PROVISIONS

This Agreement shall enter into force on the date of signature by the duly authorized representatives of both institutions and shall terminate upon fulfillment of the provisions set forth in Article III of this Agreement.

This Agreement may be terminated by mutual consent of the parties or at the request of the Master’s/Ph.D. student, with the mandatory approval of both advisors.

If either party fails to fulfill its obligations under this Agreement, the other party shall have the right to request its termination, upon prior notification. The party initiating the request is obliged to allow the other party a period of thirty (30) days to resolve the issues. The Agreement shall be terminated only if the issues remain unresolved at the end of this period.

Furthermore, this Agreement shall automatically terminate if the student XXX loses their status as a Master’s or Ph.D. student at UFSM or at XXX (name of the foreign institution) , if enrolled as a regular student in a graduate program at the foreign institution.

In witness whereof, the institutions have executed this Agreement, which also includes the signatures of the presidents of the partner institutions, the Master’s or Ph.D. student, and the advisors from both institutions, in two languages – Portuguese and English.
